AUSSIE WIND WALL TERMS AND CONDITIONS

1. ACCEPTANCE OF TERMS

By accessing, browsing or purchasing from Aussie Wind Wall, you agree to be bound by these Terms and Conditions, our Privacy Policy, Shipping Policy, Returns Policy, Warranty Policy and any additional policies published on our website.

If you do not agree to these Terms and Conditions, you must not use this website or purchase our products.

2. COMPANY INFORMATION

Aussie Wind Wall is a Queensland-based, veteran-owned business supplying windbreak, outdoor shelter and camping products throughout Australia and selected international markets.

Our products are designed and selected specifically for outdoor and recreational use, with individual product specifications and country-of-origin information provided on the relevant product pages.

3. PRODUCTS AND SERVICES

3.1 Product Range

Aussie Wind Wall offers products including, but not limited to:

  • Beach Mate
  • CampWall Pro
  • CampWall Flex
  • Anchor Bag
  • Deploy Tool
  • Camping accessories and replacement parts

Product specifications, colours, features, dimensions and availability may change from time to time.

Where a material change affects an existing customer order, we will communicate that change where reasonably practicable.

Product images are provided for illustrative purposes. Colours and appearance may vary slightly due to manufacturing variations, lighting, photography and screen settings.

3.2 Australian Made Products

Some products sold by Aussie Wind Wall are manufactured in Australia, while others are manufactured overseas to Aussie Wind Wall specifications.

Where applicable, Australian Made certification applies only to products specifically displaying Australian Made branding or certification.

Customers should refer to individual product listings for relevant country-of-origin information.

3.3 Product Performance

Performance statements, setup times, weather resistance information, wind resistance information and product demonstrations are based on testing and real-world use under specific conditions.

Actual performance may vary depending on factors including:

  • Weather conditions
  • Wind direction and strength
  • Ground conditions
  • Setup configuration
  • Anchoring method
  • Setup quality
  • Product maintenance
  • User experience

No guarantee is given that a product will perform identically in all locations, configurations or conditions.

Customers are responsible for assessing conditions and ensuring products are appropriately set up and anchored for their intended use.

3.4 Product Warranties

Product warranties are outlined in our separate Warranty Policy.

Unless otherwise stated on the relevant product page:

  • CampWall Pro includes a 24-month warranty.
  • CampWall Flex includes a 24-month warranty.
  • Beach Mate includes a 12-month warranty.

Warranty coverage applies to eligible manufacturing defects and does not generally cover normal wear and tear, misuse, accidental damage, improper setup, modifications, improper maintenance or damage caused by extreme weather or conditions outside the product's intended use.

Nothing in our warranty terms excludes or limits rights available under the Australian Consumer Law.

4. PRICING AND PAYMENT

All prices displayed on our Australian website are in Australian Dollars (AUD) and include GST unless otherwise stated.

Payment must be made using one of the payment methods available at checkout.

Aussie Wind Wall reserves the right to:

  • Change prices from time to time
  • Correct genuine pricing or listing errors
  • Refuse or cancel an order affected by an obvious pricing error

If we cancel an order due to a pricing or listing error, any amount already paid for the cancelled order will be refunded.

4.1 Pre-Orders and Deposits

Certain products may be made available for pre-order before they are available for immediate dispatch.

Where a pre-order or deposit option is offered:

  • The amount payable at the time of ordering will be clearly displayed before purchase.
  • Where only a deposit is collected initially, the remaining balance must be paid in accordance with the terms displayed at the time the pre-order is placed.
  • Estimated dispatch or availability dates are estimates only and are not guaranteed delivery dates.
  • Estimated timeframes may change due to production, transport, supply, weather or other circumstances outside our reasonable control.
  • We will endeavour to keep customers informed of material changes to the estimated dispatch timeframe.
  • Pre-orders cannot be cancelled or refunded solely because a customer changes their mind.
  • Where Aussie Wind Wall is unable to fulfil a pre-order within a reasonable timeframe, we may provide an updated timeframe and, where required by law, the customer may be entitled to cancel the order and receive a refund of amounts paid.
  • Nothing in this section excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law.

Any product-specific pre-order conditions, including deposit amount, balance payment arrangements and estimated dispatch date, will be displayed on the relevant product page or during checkout.

5. ORDER ACCEPTANCE

Placing an order does not automatically guarantee acceptance or fulfilment.

Aussie Wind Wall may refuse, limit or cancel an order where reasonably necessary, including where:

  • A product becomes unavailable
  • A genuine pricing or listing error has occurred
  • Fraudulent or suspicious activity is reasonably suspected
  • The order cannot reasonably be fulfilled
  • Incorrect customer or delivery information prevents fulfilment
  • Customer conduct towards our staff is abusive or threatening

If Aussie Wind Wall cancels an accepted order before fulfilment, amounts paid for the cancelled products will be refunded, subject to any rights or obligations that apply under Australian Consumer Law.

6. SHIPPING AND DELIVERY

Shipping and delivery timeframes displayed on our website are estimates unless expressly stated otherwise.

Delivery times may vary depending on the destination, carrier and circumstances outside our reasonable control.

Aussie Wind Wall is not responsible for delays caused by circumstances outside our reasonable control, including:

  • Freight or postal carriers
  • Customs or border clearance
  • Weather events
  • Natural disasters
  • Supply chain disruptions
  • Industrial action
  • Government action
  • Other transport disruptions

Where a significant delay affects an order, we will endeavour to provide updated information when reasonably available.

Customers are responsible for providing complete and accurate delivery information.

Risk in the goods passes to the customer upon delivery.

Additional conditions may apply to international orders, including taxes, duties or import requirements as described in our Shipping Policy or at checkout.

7. RETURNS, CANCELLATIONS AND REFUNDS

Returns and refunds are governed by our Returns Policy and Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded.

Aussie Wind Wall is not required to provide a refund or exchange where a customer simply changes their mind, except where we have expressly agreed to do so under a specific promotion or policy.

Where a return is accepted for change-of-mind or another reason that is not covered by Australian Consumer Law, the customer may be responsible for return shipping costs.

Products returned under Australian Consumer Law will be handled in accordance with the remedies available under that law.

8. PRODUCT USE AND SAFETY

Aussie Wind Wall products are intended for recreational outdoor use unless otherwise specified.

Customers are responsible for:

  • Reading and following supplied instructions
  • Safe setup and operation
  • Using suitable anchoring for the ground and conditions
  • Ensuring poles, pegs, ropes and other components are correctly installed
  • Monitoring changing weather conditions
  • Maintaining appropriate clearance from fires and other hazards
  • Inspecting products for damage before and during use

Our windbreak and shelter products must not be relied upon as protection from severe weather, storms, cyclones, hail, flooding, falling debris, fire or other hazardous conditions.

Wind conditions can change rapidly.

Users should adjust, lower, pack away or cease using a product where conditions become unsafe or exceed what can reasonably be considered suitable recreational conditions.

9. LIMITATION OF LIABILITY

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

To the extent permitted by law, Aussie Wind Wall is not liable for indirect or consequential loss arising from circumstances outside our reasonable control or from misuse, improper setup, modification, failure to follow supplied instructions or continued use of a product in unsafe conditions.

Aussie Wind Wall is not responsible for losses resulting from a customer's decision to continue using a product in conditions that are unsafe or outside its intended recreational use.

Any limitation or exclusion of liability contained in these Terms applies only to the extent permitted by law.

10. INTELLECTUAL PROPERTY

All Aussie Wind Wall branding, logos, product names, photographs, videos, written website content, graphics, marketing materials and other intellectual property remain the property of Aussie Wind Wall or their respective rights holders.

No website content or marketing material may be copied, reproduced, republished, distributed or used for commercial purposes without prior written permission.

Nothing in these Terms grants a customer ownership of Aussie Wind Wall intellectual property.

11. PRIVACY

The collection, storage and use of personal information is governed by our Privacy Policy.

By placing an order, customers consent to us using the information reasonably required to process payment, fulfil the order, provide customer service and communicate information relating to the purchase.

Marketing communications are managed separately and may be unsubscribed from in accordance with applicable law.

12. FORCE MAJEURE

Aussie Wind Wall will not be liable for a delay or failure to perform an obligation to the extent that the delay or failure results from circumstances beyond our reasonable control.

Such circumstances may include:

  • Natural disasters
  • Floods
  • Fires
  • Cyclones or severe weather
  • Pandemics
  • Government actions or restrictions
  • Supplier or manufacturing disruptions
  • Freight or transport disruptions
  • Port closures
  • Industrial action
  • Other events outside our reasonable control

Where such an event affects an existing customer order, Aussie Wind Wall will endeavour to provide updated information and fulfil the order as soon as reasonably practicable.

Nothing in this section limits any rights a customer may have under Australian Consumer Law.

13. GOVERNING LAW

These Terms and Conditions are governed by the laws of Queensland, Australia.

Any dispute relating to these Terms or a purchase from Aussie Wind Wall will be dealt with in accordance with applicable Australian law.

Nothing in this section limits any rights a consumer may have regarding the appropriate jurisdiction for a consumer claim.

14. SEVERABILITY

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision will be severed or limited to the minimum extent necessary.

The remaining provisions will continue in full force and effect.

15. CHANGES TO THESE TERMS

Aussie Wind Wall may update these Terms and Conditions from time to time.

Any changes will apply from the date the updated Terms are published on our website and will not retrospectively alter the terms applicable to an existing purchase where doing so would adversely affect a customer's existing rights.

The date of the most recent update will be displayed at the top of this page.

16. ENTIRE AGREEMENT

These Terms and Conditions, together with our Privacy Policy, Warranty Policy, Shipping Policy, Returns Policy and any specific terms displayed on a product or pre-order page, form the terms applicable to purchases made through Aussie Wind Wall.

Nothing in these Terms excludes rights or remedies that cannot legally be excluded.
